1. Acceptance of Terms

By accessing, downloading, or using SketchKiddo (the "Service"), you agree to be bound by these comprehensive Terms of Service. If you do not agree to all terms and conditions, you are strictly prohibited from using the Service. These terms apply globally to all users.

2. "As-Is" Service and No Warranties

The Service and all materials are provided on an "as-is" and "as available" basis without any warranties of any kind, whether express or implied. SketchKiddo expressly disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

3. Limitation of Liability

Under no circumstances, including negligence, shall SketchKiddo, its owners, directors, employees, partners, agents, suppliers, or affiliates, be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (A) your access to or use of or inability to access or use the Service; (B) any conduct or content of any third party on the Service; (C) any content obtained from the Service; and (D) unauthorized access, use or alteration of your transmissions or content. This applies regardless of whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage. You expressly waive any right to sue or bring any legal action against the company.

4. Indemnification

You agree to defend, indemnify, and hold harmless SketchKiddo and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

5. Global Applicability & Jurisdiction

SketchKiddo makes no representation that the Service is appropriate or available for use in all locations. Those who access or use the Service do so at their own volition and are entirely responsible for compliance with all applicable local, state, national, and international laws. Any dispute arising from these terms shall be resolved through binding arbitration, and you waive any right to participate in a class-action lawsuit.

6. Changes to Terms

We reserve the absolute right to modify or replace these Terms at any time without prior notice. Your continued use of the Service following any changes constitutes acceptance of those changes.
